Terms of Service

These terms govern your access to and use of the JomProp platform, including agent websites, listing pages, market intelligence tools, and subscription services.

1. Acceptance of Terms

By accessing or using any part of the JomProp platform — including the website, mobile-accessible pages, agent websites, listing pages, and related tools — you confirm that you have read, understood, and agree to be bound by these Terms of Service.

If you are using JomProp on behalf of a company, agency, or organisation, you represent that you have the authority to bind that entity to these terms.

If you do not agree to these terms, please discontinue use of JomProp immediately.

2. About the Platform

JomProp is a Malaysia-based property technology platform that connects property agents, owners, buyers, tenants, and investors through listing pages, agent websites, market intelligence tools, and related services.

JomProp acts as a platform intermediary. We do not act as a property agent, auctioneer, banker, valuer, solicitor, or financial adviser. We do not represent any party in a property transaction.

Listing information published on JomProp is provided by registered agents, owners, or sourced from public data. JomProp does not independently verify each listing prior to publication.

3. User Eligibility and Account Responsibility

You must be at least 18 years of age to create an account or use JomProp services.

You are responsible for maintaining the security of your account credentials. Any activity carried out under your account is your responsibility. If you believe your account has been compromised, notify JomProp immediately.

You agree to provide accurate and up-to-date information when registering an account or submitting a listing. Providing false or misleading information may result in account suspension or termination.

4. Agent Responsibilities

Agents who use JomProp to publish listings, create agent websites, or manage leads agree to the following:

  • Listing content submitted must be accurate, current, and not misleading.
  • Agents are responsible for ensuring that listings comply with applicable Malaysian law, including the Housing Development (Control and Licensing) Act, the Valuers, Appraisers, Estate Agents and Property Managers Act (VAEA), and related regulations.
  • Agents must hold the appropriate registration or licence where required by law before advertising properties for sale or rent.
  • Agents must not post duplicate listings, fabricated testimonials, or artificially inflated metrics.
  • Agents are solely responsible for all communications with buyers, tenants, and enquiring parties made via or outside the platform.

5. Listing Submission Standards

Listings submitted to JomProp must meet the following minimum standards:

  • Accurate description of the property type, location, price, and availability.
  • Images must depict the actual property or unit being advertised. Stock imagery may not be used as the primary listing image without disclosure.
  • Price must reflect the genuine asking or transactional price. Price manipulation to attract clicks is not permitted.
  • Listing details — including area, tenure, furnishing, completion status — must be accurate to the best of the agent's knowledge at time of submission.
  • Listings must be updated or removed promptly when a property is sold, rented, or withdrawn from the market.

6. Prohibited Content and Conduct

The following are not permitted on JomProp:

  • Publishing false, misleading, or fraudulent property listings.
  • Advertising properties that you do not have the authority or right to market.
  • Uploading content that infringes third-party intellectual property rights.
  • Using JomProp tools or data for scraping, systematic data extraction, or competing platform development.
  • Attempting to reverse-engineer, tamper with, or compromise JomProp systems.
  • Sending unsolicited commercial messages via lead or contact forms.
  • Any conduct that violates applicable Malaysian law.

7. Subscription and Payment

Access to paid JomProp features — including agent websites, listing management, and market intelligence tools — requires a valid subscription.

Subscription fees, billing periods, and available plans are described on the JomProp pricing page. Prices are in Malaysian Ringgit (MYR) and are subject to change with reasonable notice.

Payment is processed by JomProp's designated payment provider. JomProp does not store full payment card details.

Subscription terms, cancellation rights, and refund eligibility are governed by the JomProp Refund and Cancellation Policy and the Agent Subscription Policy.

8. Lead and Contact Data Usage

When a buyer or tenant submits an enquiry through a JomProp listing page or contact form, that lead data is made available to the listing agent for the purpose of responding to the enquiry.

Agents may not use lead data for purposes unrelated to property enquiries. Reselling, transferring, or mass-marketing to leads obtained through JomProp is not permitted.

9. Market Data and Tools Disclaimer

JomProp may provide access to market intelligence, transaction data summaries, median price indicators, and related property market tools.

This data is sourced from public datasets and is provided for general reference and informational purposes only. It does not constitute a formal property valuation, financial advice, investment advice, or a legal opinion.

Users should consult a licensed valuer, financial adviser, or solicitor for decisions that require formal professional assessment.

JomProp does not guarantee the accuracy, completeness, timeliness, or fitness for purpose of any market data provided.

10. Intellectual Property

The JomProp platform, including its design, code, branding, tools, and original content, is owned by JomProp or its licensors and protected under applicable intellectual property law.

Agents and users retain ownership of original content they submit — such as listing descriptions and images — but grant JomProp a non-exclusive, royalty-free licence to display, reproduce, and distribute such content for the purpose of operating the platform.

Unauthorised reproduction, redistribution, or use of JomProp's platform content or branding is not permitted.

11. Third-Party Links and Services

JomProp may contain links to third-party websites, services, or embedded tools including but not limited to Google Maps, WhatsApp, and payment processors.

JomProp is not responsible for the content, privacy practices, or availability of third-party services. Use of third-party services is subject to their respective terms and policies.

12. Suspension and Termination

JomProp reserves the right to suspend, restrict, or terminate any account, listing, or access to the platform where there is reason to believe that:

  • These terms have been violated.
  • A listing is inaccurate, expired, misleading, duplicated, or unlawful.
  • Account activity is fraudulent, abusive, or harmful to other users or the platform.
  • Required subscriptions have lapsed.

12a. Suspension — Additional

Where possible, JomProp will provide reasonable notice before suspending an account. JomProp may act immediately without notice in cases of serious violation.

Terminated accounts may lose access to previously stored listing data, leads, and platform features. JomProp is not liable for any loss resulting from suspension or termination arising from a breach of these terms.

13. Limitation of Liability

JomProp provides its platform on an 'as is' basis. To the fullest extent permitted by law, JomProp excludes all warranties, express or implied, regarding the platform and its content.

JomProp is not liable for any loss or damage — direct, indirect, incidental, or consequential — arising from your use of the platform, reliance on listing information, or any property transaction entered into based on content found on JomProp.

In no event shall JomProp's total liability to you exceed the subscription fees paid by you to JomProp in the twelve months preceding the event giving rise to the claim.

14. Changes to Terms

JomProp may update these terms from time to time. When material changes are made, users will be notified via email or a prominent notice on the platform.

Continued use of JomProp after the effective date of updated terms constitutes acceptance of the revised terms.

15. Governing Context

These terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these terms shall be subject to the jurisdiction of the Malaysian courts.

JomProp operates in compliance with applicable Malaysian legislation including the Personal Data Protection Act 2010 (PDPA) and the Communications and Multimedia Act 1998 where applicable.
