Auction property information on JomProp is published for reference only. Always verify auction details with official sources including e-Lelong, the appointed auctioneer, bank, or court before taking any action.

1. Source of Auction Information

Auction property listings published on JomProp may be sourced from publicly available auction notices, official auction portals, appointed auctioneers, financial institutions, courts, or other third-party sources.

JomProp does not act as an auctioneer, financial institution, solicitor, valuer, or agent in any auction transaction. JomProp is not a party to any auction process.

Auction listings are published as a general reference service to help users become aware of property auction opportunities. They do not constitute a formal auction notice, legal offer, or professional advice of any kind.

2. Verification with Official Sources

Before participating in or making any decision based on an auction listing on JomProp, users must independently verify all details with the relevant official source. This includes:

  • The official e-Lelong portal (elelong.com.my) for court-ordered auctions in Malaysia.
  • The appointed auctioneer managing the auction.
  • The financial institution or bank conducting the sale.
  • The relevant court or judicial body for court auction orders.
  • An appointed solicitor or legal adviser acting for the prospective bidder.
  • The originating auction notice or proclamation of sale document.

3. Auction Details May Change

Auction information is time-sensitive and subject to change without notice. The following details may be revised or cancelled at any time before or during the auction process:

  • Auction date, time, and venue — auctions may be postponed, rescheduled, or cancelled.
  • Reserve price — the reserve price stated may differ from the actual reserve set at time of auction.
  • Property details — built-up area, land area, tenure, title type, encumbrances, and other property particulars should be verified against official documentation.
  • Property status — the property may have been withdrawn from auction, sold prior to auction, or had an auction order set aside.
  • Encumbrances and charges — outstanding liabilities, quit rent arrears, assessment arrears, maintenance fees, or other encumbrances should be independently verified.

4. JomProp's Role

JomProp does not act in any of the following capacities in relation to any auction property listed on this platform:

  • Auctioneer or auction house.
  • Banker, financier, or mortgagee-in-possession.
  • Court officer, judicial manager, or receiver.
  • Licensed property valuer.
  • Solicitor or legal adviser.
  • Agent representing the bank, court, seller, or bidder.

4a. No Endorsement or Recommendation

The publication of an auction listing on JomProp does not constitute an endorsement, recommendation, or opinion by JomProp regarding the property, its value, its condition, or its suitability for purchase.

JomProp does not investigate, assess, or vouch for any auction property listed on the platform.

5. Bidder Due Diligence

All prospective bidders are solely responsible for conducting thorough due diligence before participating in any auction. At minimum, this should include:

  • Reviewing the Proclamation of Sale and all auction-related documents issued by the official auction authority.
  • Conducting a title search to identify any caveats, charges, or other encumbrances on the property.
  • Arranging a physical inspection of the property where possible.
  • Obtaining independent legal advice from a qualified solicitor.
  • Assessing financing options prior to bidding — successful bidders are typically required to pay a deposit immediately on the day of auction.
  • Verifying the vacant possession status and any existing tenancies or occupation.
  • Checking for outstanding service charges, quit rent, assessment, utilities, or other payables that may become the buyer's responsibility upon purchase.

6. No Guarantee of Outcome, Condition, or Title

JomProp makes no representation or warranty regarding:

  • The outcome of any auction — JomProp does not guarantee that an auction will proceed, that a property will be sold at or above reserve, or that a bid will be successful.
  • Property condition — auction properties are typically sold on an 'as is where is' basis. JomProp does not assess the physical condition, structural integrity, or habitability of any auction property.
  • Title and encumbrances — JomProp does not verify the status of title, any caveats, court orders, charges, or other encumbrances.
  • Vacant possession — the ability to take vacant possession of an auction property after purchase must be independently verified.

7. Limitation of Liability

To the fullest extent permitted by law, JomProp accepts no liability for any loss, damage, cost, or expense — whether direct, indirect, or consequential — arising from a user's reliance on auction information published on this platform, or from participation in any auction process.

Users who participate in property auctions do so entirely at their own risk.
